The appeals before us arise out of an application for a stay of proceedings on the ground of forum non conveniens in favour of the courts of Saudi Arabia. There is no doubt that the dispute in question has many significant points of connection with that jurisdiction, but the Judicial Commissioner (“the Judge”) hearing the application took the view that there were also sufficient points in favour of Singapore so that it could not be said that Saudi Arabia was clearly the more appropriate forum. Having considered the oral and written arguments of the parties, we respectfully disagree with the learned Judge and order that the proceedings be stayed.
