The respondent pleaded guilty in the District Court to one charge of voluntarily causing hurt to a public servant, a police officer, in the discharge of his duty as a public servant, an offence punishable under s 332 of the Penal Code (Cap 224, 2008 Rev Ed) (“Penal Code”). The District Judge sentenced the respondent to one week’s imprisonment. The Prosecution appealed against the sentence. We convened a three-Judge High Court to hear the appeal. After hearing both parties and the young amicus curiae appointed for this appeal, we allowed the appeal and increased the sentence to ten weeks’ imprisonment. We now give the full reasons for our decision and set out a framework to guide sentencing in such cases.
