A flat in Simei Street 4 was sold for $1,251,000 in 2011. The purchaser’s real estate agent was Lim Chee Mei (“Lim”) from the applicant company. The vendor’s agent was Fong Kok Hung (“Fong”) from the respondent company. The vendor paid Fong 2% of the sale price as his commission. No trouble arose from that, but Fong had a co-broking agreement with Lim. Therein lies the dispute. Lim claims that the co-broking agreement provided that Fong will share the 2% commission equally with her, that is, 1% of the commission amounting to $12,510. The applicant thus sued the respondent for $13,385.70 (which is $12,510 with the Goods and Services Tax (“GST”) added).
