Section 91

Inspection of medicines and medical appliances

(1)

The Port Health Officer may inspect the medicines and appliances with which a ship is required by this Part or under the Merchant Shipping Acts to be provided.

(2)

If the Port Health Officer is of opinion that the articles inspected are deficient in quantity or quality, or are placed in improper vessels, he shall give notice in writing to the Superintendent and also to the master, owner or charterer of the ship.

(3)

The master of the ship before proceeding to sea shall produce to the Superintendent a certificate under the hand of the Port Health Officer that the default found by the Port Health Officer has been remedied.

(4)

If such certificate is not so produced, the ship shall be detained until the certificate is produced, and if the ship proceeds to sea, the owner, master or consignee of the ship shall be guilty of an offence and shall be liable on conviction for each offence to a fine not exceeding $400.[104
