Section 44

Declarations by voters

(1)

The presiding officer at any polling station may, in his or her discretion, require any voter, before the voter is given a ballot paper, to furnish such evidence of the voter’s identity as the presiding officer may consider necessary and to make and subscribe to the declaration set out in Form 15 in the First Schedule.

If any person fails to furnish such evidence of his or her identity or refuses to make the declaration required under subsection (1), the presiding officer may refuse to give him or her a ballot paper.

If any person wilfully makes a false statement in the declaration required under subsection (1), the person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,500 or to imprisonment for a term not exceeding 9 months or to both.
