Expenses in excess of maximum to be illegal practice
(1)
Subject to such exception as may be allowed pursuant to this Act, no sum is to be paid and no expense is to be incurred by a candidate at an election or his or her election agent, whether before, during, or after an election, on account of or in respect of the conduct or management of the election, in excess of the amount determined in accordance with the Third Schedule.
(1A)
The amount mentioned in subsection (1) does not include any expenditure incurred by the candidate for his or her personal expenses, or any fee paid to the election agent not exceeding $500.
(2)
Any candidate or election agent who knowingly acts in contravention of this section shall be guilty of an illegal practice.
(3)
The Minister may by order amend the Third Schedule; and every such order must be presented to Parliament as soon as possible after publication in the Gazette.
(4)
Where a writ of election has been issued under section 24 for an election in any electoral division, no order under subsection (3) may be made until after the day of nomination or, if a poll is to be taken, until after polling day of that election.
