Section 257

Order to take further evidence

(1)

In dealing with any appeal under this Chapter the High Court, if it thinks additional evidence is necessary, may either take such evidence itself or direct it to be taken by a District Court or Magistrate’s Court.

(2)

When the additional evidence is taken by the District Court or Magistrate’s Court, it shall certify that evidence to the High Court and that Court shall then, as soon as possible, proceed to dispose of the appeal.

(3)

Unless the High Court otherwise directs, the accused or his advocate shall be present when the additional evidence is taken.

(4)

The taking of evidence under this section shall, for the purposes of Chapter XXIII, be deemed to be an inquiry.[256
