Section 81

Inquiry as to the truth of information

(1)

When an order under section 76 has been read or explained under section 77 to a person present in court or when a person appears or is brought before a court in compliance with or in execution of a summons or warrant issued under section 78, the court shall proceed to inquire into the truth of the information upon which it has acted and to take such further evidence as appears necessary.

(2)

The inquiry shall be made as nearly as is practicable in the manner prescribed in this Code for conducting trials in summary cases before Magistrates’ Courts except that no charge need be framed.

(3)

For the purposes of this section, the fact that a person is a habitual offender may be proved by evidence of general repute or otherwise.[80
