Section 43

Compounding of offences

(1)

Any Federal Superintendent of Customs and Excise may compound any offence, which is prescribed to be a compoundable offence, by accepting from the person reasonably suspected of having committed the offence a sum not exceeding $500.

(2)

In like manner any Federal Customs Officer may compound any offence, which is prescribed to be compoundable by that officer, by accepting from the person reasonably suspected of having committed the offence a sum not exceeding $20.

(3)

On the payment of such sum the person reasonably suspected of having committed the offence, if in custody shall be discharged, any property seized shall be released and no further proceedings shall be taken against that person or property.
