Section 47

Assaulting or obstructing Federal officers of customs and rescuing seized goods

Every person who —

(a)

assaults or obstructs any Federal officer of customs or other public servant or any person acting in his aid or assistance or duly employed for the prevention of offences under this Act, in the execution of his duty or in the due seizing of any goods liable to seizure under this Act;

(b)

rescues or endeavours to rescue, or causes to be rescued, any goods which have been duly seized; or

(c)

before or after any seizure staves, breaks or otherwise destroys any package or goods to prevent the seizure thereof or the securing of the package or goods,shall be guilty of an offence and shall be liable on conviction —

(d)

for a first offence to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 9 months or to both; and

(e)

for a second or any subsequent offence to a fine not exceeding $5,000 and to imprisonment for a term not exceeding 18 months.
