Powers of composition
(1)
The Board or any officer of the Board who is authorised by the Board in that behalf may, in its or his or her discretion, compound any offence under this Act or any rules made under section 31 which is prescribed as a compoundable offence by collecting from a person reasonably suspected of having committed the offence —
one half of the amount of the maximum fine that is prescribed for the offence; or
a sum not exceeding $5,000,whichever is the lower.
(2)
On payment of the sum of money, no further proceedings are to be taken against that person in respect of the offence.
(3)
The Board may, with the approval of the Minister, make rules prescribing the offences which may be compounded and the method and procedure by which the offences may be compounded.
(4)
All sums of money received for the composition of offences under this section must be paid into the Consolidated Fund.[27A
