Section 37

Power to fix and vary rent, licence fees and maintenance fees

(1)

The Board may from time to time with the approval of the Minister fix the amount of —

(a)

rent and licence fees payable in respect of any property provided under this Act which is subject to a tenancy or licence agreement; and

(b)

maintenance fees payable in respect of any property provided under this Act.

(2)

Despite anything contained in any tenancy or licence agreement or sale and purchase agreement in respect of any property provided under this Act, the Board has the power to vary, with the approval of the Minister, the rent, licence fees or maintenance fees fixed under subsection (1).

(3)

Any variation in the rent, licence fees or maintenance fees made under subsection (2) must be published in the Gazette and takes effect on such date as may be specified therein.[31
