Section 65
Power to require evidence as to identity, examine, etc.
(1)
For the purposes of investigating any ground under section 63(1) for acquiring any flat, house or other living accommodation, an officer authorised by the Board (called in this section an authorised officer) may do all or any of the following:
require any person who appears to be involved in or related to the matter under investigation to provide evidence of the person’s identity;
examine orally any person who appears to be acquainted with any of the facts or circumstances of the matter under investigation;
issue a written notice requiring any person within the limits of Singapore, who appears to be acquainted with any of the facts or circumstances of the matter under investigation, to attend before the authorised officer;
issue a written notice requiring any person whom the authorised officer reasonably believes to have —
any information; or
any document or thing in the person’s possession, custody or control,relevant to the investigation, to —
provide that information;
produce that document or thing at the time and place stated in the notice; or
give the authorised officer access to that document or thing.
(2)
Before exercising any power under subsection (1)(a) or (b), an authorised officer must declare his or her office and produce —
such identification card as the Chief Executive Officer may direct to be carried by the authorised officer as proof of his or her identity; and
some duly authenticated document showing his or her authority.
(3)
Any person examined under this section must state truly what the person knows of the facts and circumstances of the matter under investigation, except that the person need not say anything that might expose the person to a criminal charge, penalty or forfeiture.
(4)
A statement made by any person examined under this section must —
be reduced to writing;
be read over to the person;
if the person does not understand English, be interpreted in a language that the person understands; and
after correction (if necessary), be signed by the person.
(5)
Any person who is required by an authorised officer to do anything under subsection (1) must comply with that requirement.
(6)
If any person fails to comply with a written notice issued to the person by an authorised officer under subsection (1)(c) or (d), the authorised officer may report the failure to a Magistrate who may then, in the Magistrate’s discretion, issue a warrant ordering the person to comply with the written notice.
(7)
If a person is required merely to produce any document or thing under subsection (1)(d), the person may comply with the requirement by causing the document or thing to be produced instead of bringing it in person.[56B
