Section 67

Payment of compensation

(1)

The Board must pay the compensation determined by the Board or varied by the Minister on an appeal to an owner or to both an owner and an interested person in such proportion as the Board may decide or as may be varied by the Minister.

(2)

The Board may apply to the Registrar of the Supreme Court for an order to deposit the compensation in court where —

(a)

any person entitled to the compensation refuses to accept it or cannot with due diligence be found;

(b)

there is any dispute as to the entitlement to or the apportionment of the compensation;

(c)

the Board is satisfied that any person entitled to the compensation is incapacitated by reason of mental illness and no donee of a lasting power of attorney or deputy has been appointed under the Mental Capacity Act 2008; or

(d)

the person entitled to the compensation is deceased and no legal personal representative has been appointed.

An application under subsection (2) is to be made ex parte by originating summons, supported by an affidavit.

Despite anything to the contrary in the Rules of Court, the Registrar of the Supreme Court may make an order under subsection (2) to deposit the compensation in court.

The Board may withhold any compensation payable in respect of any flat, house or other living accommodation vested in the Board under this Act to any person until the Board has taken possession of the flat, house or other living accommodation.

(6)

Any reference to compensation in subsections (2) and (4) includes a reference to any part of the compensation.[58
