Section 34
Determination of development charge
(1)
The competent authority shall, by an order, determine whether a development charge is payable in respect of any development and, if payable, the amount thereof.
(2)
The competent authority shall serve a copy of the order on the person liable for the payment of the development charge.
(3)
Where a person who is liable for the payment of a development charge determined by the competent authority by order in accordance with section 33(3) is dissatisfied with the order, he may, within 30 days of the service of the order, appeal to the Minister whose decision shall be final.
(4)
No person may appeal against any determination of a development charge under subsection (3) unless he has paid the prescribed fee for the appeal.
(5)
A person who has made an appeal to the Minister under subsection (3) may proceed with the development without waiting for the outcome of his appeal upon payment of the development charge determined by the competent authority under subsection (1), but such payment shall be without prejudice to his appeal.
