Section 34

Court to have regard to certain matters

(1)

In determining a trade dispute, a Court may have regard —

(a)

not only to the interests of the persons immediately concerned but to the interests of the community as a whole and in particular the condition of the economy of Singapore;

(b)

to the recommendations made from time to time by the Minister under section 49 of the Employment Act 1968 relating to the matters specified in that section; and

(c)

in the case of any trade dispute relating to the re‑employment of any eligible employee under the Retirement and Re‑employment Act 1993, the tripartite guidelines relating to re-employment issued by the Minister under section 11B of that Act.

(2)

In any case where a Court has regard to the recommendations referred to in subsection (1)(b), the Court may vary or set aside any of the terms of a collective agreement or award notwithstanding section 45.
