Section 41

Presumptions

In any proceedings under this Act —

(a)

it shall not be necessary for the prosecution to prove that a mutual benefit organisation possesses a name or that it has been constituted or is usually known under a particular name; and

(b)

where it is alleged that an organisation is an unlawful organisation, the burden of proving that it is a registered organisation shall lie on the person charged.
