Section 40

Possession of driving licence belonging to another person

(1)

If the Deputy Commissioner of Police has reasonable cause to believe that a driving licence is in the possession of any person other than the person to whom it was issued, the Deputy Commissioner of Police may, by written notice served personally on the person in whose possession the licence is alleged to be, require the person immediately to deliver the driving licence to the Deputy Commissioner of Police who must, in the absence of any reason to the contrary, deliver the driving licence to the person to whom it was issued.

(2)

Any person who, without reasonable cause, fails to comply with a notice under subsection (1) shall be guilty of an offence.
