Section 85

Inquiry into accident

(1)

The Deputy Commissioner of Police may by written notice require the person alleged to have been driving or in charge of any vehicle at the time of the occurrence of any accident in which the vehicle was concerned or the commission of any offence connected with the driving of the vehicle to attend before him or her at the time and place stated in the notice for the purpose of inquiry into the accident.

The person must attend and must answer truly all questions relating to the occurrence or offence put to the person by the Deputy Commissioner of Police except that the person may decline to answer any question the answer to which would have a tendency to expose the person to a criminal charge or to a penalty or forfeiture.

(3)

No such answer may in any case be used in evidence in any proceedings, civil or criminal, except proceedings against the person on a charge of an offence under subsection (5).

(4)

The person must, if so required by the Deputy Commissioner of Police, produce his or her driving licence.

(5)

Any person who, without reasonable cause, fails to comply with any of the requirements of this section shall be guilty of an offence.
