Power of Family Court to refuse order where proceedings more convenient in General Division of High Court

(1)

If in the opinion of the Family Court the matters in question between the parties or any of them would be more conveniently dealt with by the General Division of the High Court, the Family Court may refuse to make an order and in that case there shall be no appeal from its decision.

The General Division of the High Court has power, by order in any proceedings in the General Division of the High Court relating to or comprising the same subject matter as the application refused or any part thereof under subsection (1), to direct the Family Court to rehear or determine the same.
