Section 39

Detention of any dog that has bitten a person

(1)

An authorised officer or police officer may give directions requiring the owner or person in charge of any dog that has or is reasonably believed to have bitten any person to produce the dog at such place and time as the officer may determine.

(2)

If the owner or person in charge of the dog fails to comply with the directions given to him or her under subsection (1), the authorised officer or police officer may immediately take possession of the dog and remove it to an animal quarantine station.

(3)

Any person who, without lawful excuse, fails to comply with the directions given to the person under subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000.
