Obstructing investigations, etc.
(1)
Where —
a person engages in conduct;
the person knows that the conduct, or is reckless as to whether the conduct, will adversely affect an investigation under this Part that is being conducted at that time or that could be conducted at a later time;
the conduct has the result of adversely affecting such an investigation (whether or not the investigation has started at that time); and
the conduct is not authorised by the Chief Inspector of Accidents, an Inspector or any person acting under the authority of the Minister, Chief Inspector of Accidents or Inspector under this Part,the person shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.
(2)
Subsection (1) does not apply if the person has a reasonable excuse, the burden of proof of which lies with that person.[14C
