Section 119

Service of documents on management corporation, subsidiary proprietors and others

(1)

A summons or other legal process may be served on a management corporation by leaving it with the chairman or secretary of the management corporation or of the council or with any member of the council.

(2)

A document other than a document referred to in subsection (1) may be served on a management corporation —

(a)

by leaving it with any person referred to in subsection (1) or in the receptacle provided by the management corporation under section 7; or

(b)

by sending it, by registered post, to the management corporation at its address recorded on the folio of the land-register comprising the common property.

(3)

Subject to the provisions of this Act, a notice or other document required or authorised by this Act or the by-laws to be served bythe Commissioner, a management corporation, a council or the secretary of a council on a proprietor, subsidiary proprietor, lessee, mortgagee or occupier of a lot may be served —

(a)

by leaving it —

(i)

where the person to be served is an occupier of the lot, at the address of the lot; or

(ii)

where an address for the service of notices on the person to be served is recorded in the strata roll, at the address so recorded;

(b)

by sending it, by registered post, to the person to be served, where an address for the service of notices on that person is recorded in the strata roll, at the address so recorded and, if that notice or document is not returned through the post office as undelivered, that service shall be deemed to have been made at the time at which the registered letter would in the ordinary course be delivered; or

(c)

in the case of a subsidiary proprietor, by affixing the notice on the front door of his lot.

(4)

Section 60(3) of the Land Titles Act (Cap. 157) shall apply to the service of documents on a management corporation and a subsidiary proprietor.

This section shall not apply to notices served in proceedings in the court.
