Application to decide question whether person is a member of a body corporate
(1)
When any question arises as to whether any person is a member of such body corporate, any person interested in the question may apply by originating summons to the court for its opinion on the question.
(2)
Notice of the hearing must be given to such persons and in such manner as the court thinks fit.
(3)
Any opinion given by the court on an application under this section is binding —
on the person in respect of whom the question arose;
upon all members of the body corporate mentioned in subsection (1);
upon that person interested in the question; and
upon any persons to whom notice of the hearing has been given in accordance with any direction of the court.
