Maintenance of refuse chutes in buildings
(1)
The owner or the owners of any building or part thereof served by a refuse chute and chute chamber shall be responsible for the repair, replacement and maintenance of every such refuse chute and chute chamber.
(2)
The Commissioner may, by notice in writing, require the owner or the owners of any such building or part thereof to carry out any repairs, replacement or maintenance to, of or in connection with any such refuse chute or chute chamber as the Commissioner may consider necessary, and every such notice shall be complied with within such period as may be specified in the notice unless extension of the period has been granted by the Commissioner.
(3)
Any person who fails to comply with any such notice within the period specified therein, including any extension thereof, shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 and to a further fine not exceeding $50 for every day during which the offence continues after conviction.
(4)
Where any person who has been served with any such notice fails to comply therewith, the Commissioner may, in his discretion, without prejudice to any proceedings under subsection (3) and whether before or after the commencement or conclusion of the proceedings, carry out such works as are specified in the notice and recover from that person the costs and expenses thereof in the manner provided in section 121.[17
