Prohibition on use of night-soil as manure
(1)
No land shall be manured with night-soil or human excreta.
(2)
If any night-soil or human excreta is found in any place collected in pits or receptacles of any kind such as would in the ordinary course be used for preparing such night-soil or human excreta for purposes of manuring, this shall be deemed conclusive evidence that the land on which such pits or receptacles are situated or land in the same occupation adjoining or contiguous thereto has been manured with night-soil or human excreta.
(3)
The owner and the occupier of any land which is manured with night-soil or human excreta shall both be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,500 and to a further fine of $100 for every day during which the offence continues after conviction, and in the case of a second or subsequent conviction to the like fines or to imprisonment for a term not exceeding 6 months or to both.
(4)
A Magistrate’s Court may, on the application of the Commissioner, make a mandatory order against the owner or the occupier of such land, requiring him to remove such night-soil or receptacles or to fill up such pits, as the case may be.[25
