Prohibition of cultivation or use of manure or irrigation which is a nuisance
(1)
If at any time it appears to the Commissioner that the method of cultivation of any description of crop or the use or storing or method of preparing or dealing with any kind of manure (including prawn dust, chicken droppings and stable refuse) not prohibited by section 24 or the irrigation of land in any specific manner in any area is a nuisance, the Commissioner may prohibit such method of cultivation or such use or storing or method of preparing or dealing with such manure or such manner of irrigation within such area or may regulate any of the aforesaid by imposing such condition or conditions thereon as the Commissioner may consider necessary for the prevention of the nuisance.
(2)
The Commissioner may, in his discretion, publish notice of such prohibition or condition or conditions in the Gazette.
(3)
The owner and the occupier of any land who disregards or fails to comply with any prohibition or condition imposed by the Commissioner under subsection (1) shall both be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 and to a further fine of $100 for every day during which the offence continues after conviction, and in the case of a second or subsequent conviction to the like fines or to imprisonment for a term not exceeding 6 months or to both.[27
