Section 82

Buildings to which the public has access to be kept clean

(1)

The owner, the occupier or the lessee of any building or any part thereof to which the public has access shall —

(a)

regularly clean and keep clean and in good repair such building or part thereof; and

(b)

keep such building or part thereof free of such conditions as may endanger the lives or health of his employees, members of the public and other users thereof.

(2)

Where, in the opinion of the Commissioner, the owner, the occupier or the lessee of any such building or part thereof fails to comply with subsection (1)(a) or (b), the Commissioner may, by notice in writing, require such owner, occupier or lessee within such period as may be specified therein to take such steps as the Commissioner may think fit.

(3)

In any notice issued by the Commissioner under subsection (2), the Commissioner may, in the case of an air-conditioned building or part thereof, —

(a)

prescribe temperature and humidity controls for such air-conditioned building or part thereof; and

(b)

require the owner, occupier or lessee of such building or part thereof —

(i)

to install automatic devices for recording the temperature and humidity level in such building or part thereof; and

(ii)

to keep such records and charts of the temperature and humidity level in such building or part thereof as the Commissioner may direct for the inspection of the Commissioner.[7/74

(4)

Any person who contravenes any of the provisions of subsection (1), or refuses, neglects or fails to comply with any notice issued by the Commissioner under subsection (2) within such period as may be specified therein, shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000 and to a further fine not exceeding $25 for every day during which the offence continues after conviction.

(5)

Where any person who has been served with a notice under subsection (2) fails to comply therewith, the Commissioner may, in his discretion, without prejudice to any proceedings under subsection (4) and whether before or after the commencement or conclusion of such proceedings, carry out all or any of the requirements set out in the notice and recover from such person the costs and expenses thereof in the manner provided in section 121.[85
