President

The Chief Justice may appoint a Judge of the Appellate Division to be the President of the Appellate Division.

If no appointment is made under subsection (1), the Chief Justice is the President of the Appellate Division.

In a sitting of the Appellate Division —

(a)

the most senior Supreme Court Judge, as determined by section 4, is to preside; and

(b)

if there is no Supreme Court Judge, the Chief Justice is to appoint a person to preside.
