Section 12

Power of Controller to sell animals or perishable, deleterious or hazardous articles

(1)

If the Controller takes possession of any controlled article in circumstances in which —

(a)

the Controller has reason to believe that an offence under this Act has been committed; and

(b)

criminal proceedings have been instituted against any person in respect of the offence,then if —

(c)

the controlled article is a live animal; or

(d)

the Controller is satisfied that the controlled article, by reason of its perishable nature or otherwise, is liable to deteriorate, or is injurious to health or is hazardous,the Controller may order that the controlled article be sold in the manner that may be specified by the Controller.

(2)

The proceeds of the sale mentioned in subsection (1) must be kept until the conclusion of the criminal proceedings and, except where the court orders confiscation of the proceeds under section 26, must be disposed of in the manner that the court may order.
