Composition of offences
(1)
The relevant officer may compound any offence under this Act or any subsidiary legislation made under this Act that is prescribed as being an offence that may be compounded by doing one or both of the following:
by collecting from a person reasonably suspected of having committed the offence a sum not exceeding the lower of the following amounts: (i)one half of the amount of the maximum fine that is prescribed for the offence;
$5,000;
by requiring the person reasonably suspected of having committed the offence to do, or to refrain from doing, such things as are specified in an offer of composition (called conditions of composition) by the relevant officer, with the concurrence (general or specific) of the Public Prosecutor.
(2)
On payment of the sum of money or meeting the requirement in subsection (1)(a) or (b) or both, no further proceedings are to be taken against that person in respect of the offence.
(3)
All sums collected under this section must be paid into the Consolidated Fund.
(4)
In this section, “relevant officer”, for an offence that is prescribed as being an offence which may be compounded, means the Superintendent where the offence is an offence under any other provision of this Act or any other subsidiary legislation made under this Act.
