Amendments to the Poisons Act 1938
SECOND SCHEDULESection 76(2)Amendments to the Poisons Act 19381. In section 6 —
delete the word “and” appearing at the end of subsection (1)(a)(iv);
delete subsection (1)(a)(v); and
delete the words “or to some pharmacist in the employment of the seller at the premises where the sale is effected,” appearing in the second, third and fourth lines of subsection (3)(a).
2. Section 7 is repealed.
3. In section 9(3), delete the words “or for dispensing purposes” appearing in the first and second lines.
4. In section 11(1) —
delete the words “; or” appearing at the end of paragraph (c) and substitute therefor a full-stop; and
delete paragraph (d).
5. In section 17(1), delete the words “sections 7 and” appearing in the fourth line and substitute therefor the word “section”.
6. In section 21(1) —
delete the words “(c) or (d)” appearing in the third line of sub-paragraph (i) of paragraph (c);
delete sub-paragraph (ii) of paragraph (c); and
delete paragraphs (g) and (i).
7. After section 21, insert the following:“Non-application of this Act to medicinal product or substance
22. Nothing in this Act shall apply to any poison which is incorporated in a medicinal product or used as a substance for a medicinal purpose and which is regulated by the provisions of the Medicines Act 1975.”.
