Section 100BA

False or misleading statement or information to induce person to join society, etc.

Any member or officer of a society shall be guilty of an offence, and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 2 years or to both, if that member or officer —

(a)

makes or disseminates any statement that is false or misleading in a material particular, with the intention of inducing another person —

(i)

to become a member of the society; or

(ii)

to enter into any contract, transaction or arrangement with the society for the benefit of the society or its members; and

(b)

at the time the statement is made or disseminated, knows that, or is reckless as to whether, the statement is false or misleading in a material particular.
