Section 8

Directions by Minister

(1)

The Minister may —

(a)

after consultation with the Corporation or otherwise, give such directions, not inconsistent with the provisions of this Act —

(i)

as to the policy to be followed by the Corporation in the performance of its functions and powers under this Act; or

(ii)

as to any matter or thing concerning the operation or administration of the Corporation,as appear to the Minister to be necessary, expedient or prudent; and

(b)

give specific directions to the Corporation in the interests of public safety, public order, national security or national defence,and any such direction shall be binding upon the Corporation which shall be bound to give immediate effect to it.

(2)

In the event of the Corporation failing to give immediate effect to any such direction or specific direction, as the case may be, the Minister, if he is of the opinion that an emergency has arisen in which it is expedient in the public interest that all or any of the functions and powers of the Corporation under sections 5 and 6 should be suspended, may, by order, suspend the Corporation from performing all or any of its functions and powers.

(3)

The Minister may modify or revoke such order at such time as, in his opinion, he considers it expedient to do so.

(4)

It shall be lawful for the Minister, if he considers that it is expedient to do so in the public interest, to take over and exercise all or any of the functions and powers of the Corporation for any period and at any time until such order of suspension is revoked.

(5)

The Corporation shall give the Minister such information or facilities for obtaining information with regard to the exercise of its functions in such manner and at such times as the Minister may reasonably require.
