Section 26

Claims may be heard together

(1)

Subject to subsection (2), where 2 or more claims are filed and it appears to a tribunal that —

(a)

a common question of fact or law arises in both or all of them;

(b)

the claims arose out of the same cause of action; or

(c)

it would be in the interests of justice,the tribunal may order that such claims (called in this section the common group of claims) be heard at the same time.

(2)

The aggregate value of the common group of claims must not exceed —

(a)

in the case where section 5(4) applies to any claim in the common group of claims, the prescribed extended limit; and

(b)

in any other case, the prescribed limit.

The power conferred by this section may be exercised by a tribunal even though the hearing of any claim in the common group of claims has begun.
