Section 44
Delay or denial of justice
(1)
Where any person is under arrest or in custody for an alleged service offence, a person who does not take such action as is required of the person by or under this Act —
to have the case of the firstmentioned person brought before a commanding officer for investigation; or
to have the case of the firstmentioned person disposed of or tried summarily by a disciplinary officer,shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding 2 years or any other punishment authorised by this Act.
(2)
Where a person in custody under this Act is entitled to be released, a person who does not take such action as is required of him or her by or under this Act to release, or to order the release of the firstmentioned person shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding 2 years or any other punishment authorised by this Act.
