Section 45

Resistance to arrest

Any person who —

(a)

refuses to obey a lawful order for the person’s arrest; or

(b)

commits an assault on —

(i)

a member who gives the order; or

(ii)

a person, whether a member or not who attempts to apprehend the firstmentioned person, or take or hold the firstmentioned person in custody, pursuant to the order,shall be guilty of an offence and shall be liable on conviction to imprisonment for a term not exceeding 3 years or any other punishment authorised by this Act.
