Council

(1)

The Institute shall have a Council which shall consist of —

(a)

8 practising members of the Institute to be elected by the practising members of the Institute;

(b)

8 non-practising members of the Institute to be elected by the non-practising members of the Institute; and (c)3 members nominated by the Government all of whom shall be appointed by the Minister.

(2)

The Council may, from time to time, in its discretion appoint any member of the Institute to be a co-opted member of the Council except that there shall not be more than 2 co-opted members in office at any one time.

(3)

A practising member shall not be eligible for election or appointment as a member of the Council if —

(a)

the Board has made any order referred to in section 34(2) against him;

(b)

within a period of 12 months preceding the date of the election, he has been disciplined by the Council or any committee appointed by the Council; or

(c)

he has been convicted of an offence involving fraud or dishonesty.

(4)

A non-practising member shall not be eligible for election or appointment as a member of the Council if —

(a)

within a period of 12 months preceding the date of the election, he is disciplined by the Council or any committee appointed by the Council;

(b)

at any time, he has been suspended as a member of the Institute for a period of 6 months or more; or

(c)

he has been convicted of an offence involving fraud or dishonesty.

(5)

The President, the Vice-President and the Treasurer of the Institute shall be elected by the Council from among its members.

(6)

In the event of any casual vacancy arising in respect of the office of the President, Vice-President or Treasurer of the Institute, the Council shall at its next meeting or as soon as possible thereafter elect one of its members to fill the vacancy.

(7)

The President of the Institute shall be the chairman of the Council and shall preside at all its meetings.

(8)

In the absence of the President of the Institute at any meeting of the Council, the Vice-President of the Institute shall preside and in the absence of the President and the Vice-President of the Institute at any such meeting the members present shall elect one of their number to preside.

(9)

A practising member or non-practising member shall before his appointment or election as a member of the Council file a declaration with the Institute stating that he is not disqualified from holding office as a member of the Council by virtue of subsection (3) or (4).

(10)

Any person who fails to comply with subsection (9) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $1,000.[29
