Section 82

Penalty for obstruction

(1)

A person must not at any time —

(a)

hinder, obstruct or delay the Director‑General, any authorised officer or other person in the performance and execution of his or her duty or of anything which he or she is respectively empowered, employed or required to do by virtue or in consequence of or under this Act; or

(b)

remove any mark, line, sign or other direction drawn or set up for the purpose of this Act.

However, it is not an offence under subsection (1) for any person to refuse to comply with any request, demand or order made or given by any authorised officer (including an authorised officer within the meaning of section 31W) who fails to declare his or her office and refuses to produce his or her identification card on demand being made by that person.

In subsection (2), “identification card”, for an authorised officer (including an authorised officer within the meaning of section 31W), means such identification card as the Director‑General or the Director‑General, Food Administration may require the authorised officer to carry at all times when exercising powers under this Act.
