Section 12

Procedure where appearance of executant or witness is desired

(1)

If any person presenting any instrument for provisional registration desires the appearance of any person whose presence or testimony is necessary for the provisional registration of the instrument, the Registrar may issue a summons requiring him or her to appear at the Registry either in person or by a duly authorised agent as in the summons mentioned and at the time named therein.

(2)

A person who by reason of bodily infirmity is unable without risk or serious inconvenience to appear at the Registry and a person in jail under civil or criminal process are not required so to appear, but in every such case the Registrar must either himself or herself go to the house of that person or to the jail in which that person is confined and examine him or her or issue a commission for his or her examination.

(3)

The law in force for the time being as to summonses, commissions and compelling the attendance of witnesses and for their remuneration in suits before a District Court applies with the necessary modifications to any summons or commission issued and any person summoned to appear under this Act.
