Investigations

(1)

The Minister may direct an investigation under this Part into the affairs of a Town Council if —

(a)

there are reasonable grounds to suspect a material irregularity in or affecting the conduct of the Town Council’s affairs; or

(b)

any document or information the production of which has been required of a person under section 58 has not been produced in compliance with that requirement, and the inspector concerned has reasonable grounds to believe that the person will not produce the document or information in compliance with that requirement.

(2)

An investigation under subsection (1) is to be carried out by an inspector, or 2 or more inspectors, assigned to the investigation by the Minister.

The inspector or inspectors assigned under subsection (2) to carry out an investigation of a Town Council must report to the Minister and the Town Council on the results of the investigation.[43B
