Section 78

Relationship between Board and Town Council

(1)

To avoid doubt, any function, power, requirement or duty conferred on a Town Council by this Act must be performed or exercised in a way that is consistent with the title and rights of the Board as owner of the common property within the Town for which the Town Council is established.

Despite section 75, where a Town Council is dissolved by order under section 3, the Board is, upon the dissolution of that Town Council and pending the establishment of another Town Council for the Town, responsible and liable, as the owner of the housing estates within the Town, for the maintenance and management of such housing estates and is entitled to enforce the performance of the terms, covenants and conditions in the leases relating to such housing estates as if this Act had not been enacted.[55
