Preservation of secrecy

(1)
Except for the purpose of performing his or her duties or exercising his or her functions or when lawfully required to do so by any court or where required or allowed by the provisions of any written law, a member, officer, employee or agent of the Agency must not disclose any information relating to the affairs of any person which has been obtained by the member, officer, employee or agent in the performance of his or her duties or the exercise of his or her functions.

Any person who contravenes subsection (1) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $2,000 or to imprisonment for a term not exceeding 12 months or to both.
