Section 23

Powers of entry, etc., for enforcement purpose

(1)

The Director‑General, a protector or any officer generally or specially authorised in that behalf in writing by the Director‑General or a protector may, for an enforcement purpose, do all or any of the following:

(a)

enter, and for that purpose, use such force as may be reasonably necessary, and search any premises where he or she has reasonable cause to suspect that an offence under this Act has been or is being committed;

(b)

take any document or other thing at the premises mentioned in paragraph (a), if the Director‑General, protector or authorised officer considers it necessary to do so for the purpose of obtaining evidence of an offence under this Act;

(c)

photograph or film, or make audio recordings or make sketches, of any part of the premises mentioned in paragraph (a) or anything at the premises or of any person whom the Director‑General, protector or authorised officer reasonably believes is acquainted with any facts or circumstances relevant to the enforcement purpose;

(d)

photograph any child or young person who is found at the premises mentioned in paragraph (a) or anywhere else, and whom the Director‑General, protector or authorised officer is satisfied on reasonable grounds that the child or young person is in need of care or protection.

(2)

In this section, “enforcement purpose” means —

(a)

ensuring that the provisions of this Act are being complied with; or

(b)

investigating an offence under this Act or a contravention of a provision under this Act.[19
