Section 79

Custody of children and young persons not released on bail

(1)

The Minister may provide or appoint such remand homes as may be required for the purposes of this Act.

(2)

Whenever any person apparently below the age of 16 years has been arrested and is not released on bail, any police officer must, despite anything to the contrary in any other written law, cause that person to be remanded in a remand home until he or she can be brought before a court unless the officer certifies —

(a)

that it is impracticable to do so;

(b)

that he or she is of so unruly a character that he or she cannot be safely so remanded; or

(c)

that by reason of his or her state of health or of his or her mental or bodily condition it is inadvisable to so remand him or her.

(3)

The certificate must be produced to the court before which the person is brought.[53
