Section 26

Sharing of facilities

(1)

The Authority may direct any broadcasting licensee or broadcasting apparatus licensee to coordinate and cooperate, in such manner and on such terms as the Authority may specify, with any other licensee or any other person specified by the Authority in the use or sharing of any broadcasting apparatus or related equipment or facility (other than a telecommunication system licensed under section 5 of the Telecommunications Act 1999) owned, operated or used by the broadcasting licensee or broadcasting apparatus licensee for the purpose of broadcasting, whether or not they have been provided, or are intended to be provided, by the licensee or any other licensee or any other person specified by the Authority.

(2)

The Authority may direct any broadcasting licensee to coordinate and cooperate, in such manner and on such terms as the Authority may specify, with any telecommunication licensee in the use or sharing of any, or part of any, installation, plant or system owned or used by the telecommunication licensee, where the Authority is of the view that such coordination and cooperation is necessary for the provision of any broadcasting service.

In this section, “telecommunication licensee” and “telecommunication system” have the meanings given by section 2 of the Telecommunications Act 1999.
