Section 29A

Eligibility for grant of patent, etc.

(1)

Where an examination report issued under section 29(4), a search and examination report issued under section 29(5) or a supplementary examination report issued under section 29(6) does not contain any unresolved objection, the Registrar must issue to the applicant a notice of eligibility to proceed to the grant of a patent.

(2)

Where the Registrar has issued to the applicant a notice under subsection (1) —

(a)

the applicant must satisfy the conditions under section 30(a) and (c) within the prescribed period; and

(b)

if the applicant fails to comply with paragraph (a), the application is treated as abandoned.

(3)

Where an examination report issued under section 29(4), a search and examination report issued under section 29(5) or a supplementary examination report issued under section 29(6) contains one or more unresolved objections, the Registrar must issue to the applicant a notice of intention to refuse the application for a patent.

(4)

Where the Registrar has issued to the applicant a notice under subsection (3) —

(a)

the applicant may, within the prescribed period, apply for a review of the examination report, search and examination report or supplementary examination report, as the case may be, in accordance with section 29B(1); and

(b)

if the applicant fails to apply for the review under paragraph (a), the application for a patent must be refused.
