Formal defect not to invalidate proceedings or acts
(1)
No proceedings in bankruptcy shall be invalidated by any formal defect or by any irregularity, unless the court before which an objection is made to the proceedings is of the opinion that substantial injustice has been caused by the defect or irregularity and that the injustice cannot be remedied by any order of that court.
(2)
The acts of a person as the trustee of a bankrupt’s estate or as a special manager, and the acts of the creditors’ committee appointed for any bankruptcy, shall be valid notwithstanding any defect in the appointment, election or qualifications of the trustee or manager or, as the case may be, of any member of the committee.
