Section 16

Illegal practice

(1)

No person shall practise as, or by advertisement or otherwise hold himself out to be, a contact lens practitioner unless —

(a)

he is registered as a contact lens practitioner under this Act and has in force a licence authorising him to practise as such; or

(b)

he has in force a provisional licence authorising him to practise as a contact lens practitioner.

(2)

No person shall employ as a contact lens practitioner any person who does not have in force a licence authorising him to practise as such.

(3)

Any person who contravenes subsection (1) or (2) shall be guilty of an offence and shall be liable on conviction to a fine not exceeding $10,000 or to imprisonment for a term not exceeding 6 months or to both and, in the case of a second or subsequent conviction, to a fine not exceeding $20,000 or to imprisonment for a term not exceeding 12 months or to both.
