Security for costs of detention of unsafe ships
(1)
Where a complaint is made to the Director that a ship is an unsafe ship, the Director may, if he or she thinks fit, require the complainant to give security to his or her satisfaction for any costs and compensation which the Director may become liable to pay in consequence of the detention and survey of the ship.
(2)
Such security must not be required where the complaint is made by 3 or more crew members belonging to the ship and is not in the opinion of the Director frivolous or vexatious, and if the complaint is made in sufficient time before the sailing of the ship, the Director must take proper steps to ascertain whether the ship ought to be detained.
(3)
Where a ship is detained in consequence of any complaint, and the circumstances are such that the Authority is liable under section 202 to pay to the owner of the ship any costs or compensation, the complainant shall be liable to pay the Authority all costs incurred and compensation paid by the Authority in respect of the detention and survey of the ship.
